1 About Clawa

Clawa ("Company", "we", "us", or "our") is a content automation platform that enables users ("you", "User") to automate the creation, scheduling, and publishing of short-form video content to social media platforms including TikTok, Instagram, Threads, and YouTube.

Clawa is operated from Indonesia. Our platform is accessible via app.clawa.pro.

These Terms of Service ("Terms") govern your access to and use of the Clawa platform, website, and related services (collectively, the "Service").

2 Eligibility & Account Registration

To use Clawa, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Not be located in a country subject to applicable trade sanctions or embargoes
• Comply with all applicable local, national, and international laws and regulations

When registering, you agree to provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must notify us immediately at clawa.contact@gmail.com if you suspect unauthorized access to your account.

We reserve the right to refuse registration or cancel accounts at our sole discretion.

3 Subscription & Payments

Clawa offers subscription-based access to its platform. By subscribing, you agree to the following:

• Billing — Subscription fees are charged in advance on a monthly or annual basis, depending on the plan you select
• Automatic renewal — Subscriptions automatically renew unless cancelled before the renewal date
• Cancellation — You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of the current billing period
• Refunds — Subscription fees are non-refundable except where required by applicable law. If you believe you are entitled to a refund, contact us within 7 days of the charge
• Price changes — We reserve the right to change subscription pricing. We will notify you at least 30 days before any price change takes effect
• Taxes — Prices do not include applicable taxes. You are responsible for any taxes imposed on your use of the Service

4 Acceptable Use

By using Clawa, you agree that you will not:

• Violate any applicable law, regulation, or third-party rights
• Use the platform to publish content that violates TikTok's, Instagram's, YouTube's, or Threads' community guidelines or terms of service
• Publish or distribute content that is illegal, defamatory, hateful, violent, sexually explicit, or infringes any intellectual property rights
• Use Clawa to send spam, unsolicited messages, or engage in deceptive practices
• Attempt to circumvent platform rate limits, authentication, or security measures
• Reverse engineer, decompile, or disassemble any part of the Clawa platform
• Resell, sublicense, or transfer access to the platform to any third party without our written consent
• Use automated bots or scrapers (other than Clawa's own automation) against the Service
• Interfere with or disrupt the integrity or performance of the Service

You are solely responsible for the content published through your Clawa account. Clawa is a tool — we do not review or endorse the content you publish.

5 Third-Party Platform Integration

Clawa integrates with third-party social media platforms (including TikTok, Instagram, YouTube, and Threads) via their official APIs. By connecting your social media accounts to Clawa:

• You authorize Clawa to act on your behalf to publish content to those platforms
• You represent that you have the right and authority to connect those accounts and publish content through them
• You acknowledge that your use of those platforms is governed by their respective terms of service and community guidelines, which you are independently responsible for complying with
• You agree that Clawa is not responsible for any actions taken by third-party platforms, including the removal of content, suspension of accounts, or changes to API access

Clawa's integration with TikTok is subject to and governed by the TikTok Developer Terms of Service.

Third-party platforms may change their APIs or terms at any time. Clawa is not liable for any interruptions to the Service caused by such changes.

6 AI-Generated Content

Clawa uses artificial intelligence tools to assist in generating scripts, captions, and hashtags. Regarding AI-generated content:

• AI-generated content is provided as a draft and creative aid — it is your responsibility to review and verify content before publishing
• Clawa does not guarantee the accuracy, originality, or appropriateness of AI-generated content
• You are solely responsible for any AI-generated content that you publish through the platform
• AI-generated content may not always be unique — similar content may be generated for other users
• We do not claim ownership of content generated for you through the platform; however, you grant Clawa a limited license to process and transmit that content as needed to provide the Service

7 Intellectual Property

Your content: You retain all ownership rights to the content you create, upload, or publish through Clawa. By using the Service, you grant Clawa a limited, non-exclusive, royalty-free license to store, process, and transmit your content solely for the purpose of providing the Service.

Our platform: All intellectual property rights in the Clawa platform, including its software, design, trademarks, and documentation, are owned by Clawa or its licensors. You may not copy, reproduce, modify, distribute, or create derivative works of any part of the Clawa platform without our prior written consent.

Feedback: If you provide feedback or suggestions about the Service, you grant us the right to use that feedback without compensation or attribution to you.

8 Disclaimer of Warranties

Specifically, we do not warrant that:

• The Service will be available at all times or free from errors
• Content published through the Service will not be removed or rejected by third-party platforms
• AI-generated content will be accurate, complete, or suitable for any purpose
• The Service will meet your specific requirements or expectations

9 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLAWA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, or business
• Loss of data or content
• Reputational damage
• Costs of substitute services
• Third-party platform actions, including account suspensions or content removal

In any event, Clawa's total aggregate liability to you for any claims arising under or related to these Terms shall not exceed the total amount you paid to Clawa in the 3 months preceding the event giving rise to the claim.

10 Termination

By you: You may terminate your account at any time by cancelling your subscription and deleting your account through the platform settings, or by contacting us at clawa.contact@gmail.com.

By us: We reserve the right to suspend or terminate your access to the Service immediately, without notice, if:

• You materially breach these Terms
• We are required to do so by law or at the request of a third-party platform provider
• We determine that your use of the Service poses a risk to other users or to the Service itself

Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy, subject to any applicable legal retention requirements.

11 Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to conflict of law principles.

Any dispute arising from or related to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts of Indonesia.

If you are a consumer located in the European Union, you may also contact your local consumer protection authority or use the EU's Online Dispute Resolution platform.

12 Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a prominent notice on the platform at least 14 days before the new terms take effect.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree with the updated Terms, you must stop using the Service and cancel your subscription before the changes take effect.
